Terms &
Conditions
1. Who we are
This website, chillisurfboards.co.za, is operated by The Barrel Collective (Pty) Ltd ("we", "us"), Jeffreys Bay, 6330, South Africa, the official South African distributor of Chilli Surfboards (Australia). By using this site or placing an order you agree to these terms. If you do not agree, please do not use the site or order from us.
Contact: info@chillisurfboards.co.za · WhatsApp +27 82 825 2475.
2. How ordering works
Every board we sell is made to order to the model, length and options you choose. Submitting the order form on this site sends us your request via WhatsApp (or email). It is an enquiry, not a binding contract. We review your request, may recommend a different size based on your weight and ability, and then send you a written quote. A contract is formed only once you accept the quote and we confirm receipt of your deposit.
No prices are shown on this site. Pricing, including any charges for colour sprays, fin systems or other custom options, is confirmed in your quote in South African Rand (ZAR) and includes VAT where applicable.
3. Deposits and payment
- A deposit, as stated in your quote, is required to confirm an order and start production.
- The balance is payable before the board is dispatched or collected.
- Payment is by EFT or other method agreed in writing. Boards remain our property until paid for in full.
4. Lead times
Lead times are estimates and are confirmed in your quote. They depend on the factory production schedule, shipping to South Africa and customs clearance, and can change for reasons outside our control (for example shipping delays, materials supply or customs inspections). We will keep you informed, but a delay does not entitle you to cancel or to compensation unless we agree otherwise in writing.
5. Changes and cancellations
- You may change or cancel an order free of charge before production begins — tell us in writing (WhatsApp or email).
- Once production has begun, the board is being built to your specification and cannot be cancelled. The deposit is non-refundable and the balance remains payable.
- If we cannot fulfil your order (for example a model is discontinued), we will offer an alternative or refund any amounts paid in full.
6. Returns on custom boards
Because every board is made to order to your chosen specification, custom boards cannot be returned or exchanged for change of mind, incorrect size choice or because a board does not suit your surfing. We strongly recommend using the dimension charts on each model page and asking us for sizing advice before ordering. This does not affect your rights under the Consumer Protection Act, 68 of 2008 (CPA) in respect of defective goods (see section 8).
7. Delivery, collection and damage in transit
- We deliver anywhere in South Africa by courier, or you can collect in Jeffreys Bay by arrangement. Delivery charges are quoted separately.
- Risk in the board passes to you on delivery to the address you provided, or on collection.
- Inspect your board on delivery, before signing. If the packaging or board is damaged, note it on the courier's waybill, photograph it and notify us within 48 hours. Claims for transit damage reported after 48 hours or without waybill notation may be refused by the courier and we may be unable to assist.
- We are not responsible for delays caused by the courier, incorrect address details supplied by you, or your unavailability to receive delivery.
8. Warranty and defects
Your boards are covered by the implied warranty of quality in the CPA. In addition, we warrant each board against defects in materials and workmanship for six months from delivery. If a defect appears in this period, contact us with photographs; we will arrange inspection and, at our option, repair, replace or refund in accordance with the CPA.
The warranty does not cover: normal wear and tear; pressure dents, dings, cracks or delamination caused by impact, heel dents or misuse; damage from heat or sun exposure (for example leaving a board in a car or in direct sun), water ingress through unrepaired damage, or exposure to solvents; damage from improper fin installation or over-tightening; use of the board for anything other than surfing; or any repairs or modifications not carried out by us. Colour sprays and resin tints are hand-finished and minor variation is not a defect.
9. Your information
We process the personal information you give us to prepare your quote, build and deliver your board and stay in touch about your order, in line with our Privacy Policy and the Protection of Personal Information Act, 4 of 2013 (POPIA).
10. Intellectual property
Chilli Surfboards names, logos, model names, board designs, photographs and descriptions are the property of Chilli Surfboards and/or The Barrel Collective (Pty) Ltd and are used under licence. You may not copy or reuse them without written permission.
11. Liability
Surfing is an inherently risky activity. To the extent permitted by law, we are not liable for any injury, loss or damage arising from the use of a board, and we are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot be excluded under South African law, including under the CPA.
12. General
These terms are governed by the laws of the Republic of South Africa. If any part of these terms is found to be unenforceable, the rest remains in force. We may update these terms from time to time; the version on this page at the time you place your order applies to that order. Disputes may be referred to the National Consumer Commission or the courts of South Africa.
